General
1.1. These purchase conditions describe the ordering process for the delivery of TD Sportswear products.
1.2. The purchase conditions do not replace the General Terms and Conditions of TD Sportswear.
Ordering Process for Customers
The ordering process for sportswear generally consists of the following steps:
Step 1: Completion of your own design or with a designer.
Step 2: Determining sizes.
Step 3: Payment.
Step 4: Delivery.
Design (Step 1)
3.1. You can create your design using our design module or request assistance from a designer. We provide free help in creating a design.
3.2. Upon request, a customer can receive a digital proof via email. This allows for any errors to be corrected before finalizing the order. Once the customer has given approval, no claims can be made regarding minor design or color deviations.
3.3. It is possible to order a physical product as a sample. The sample is an actual garment in the confirmed design and with the desired finish. The delivery time is approximately three weeks.
3.4. If no sample is ordered, the customer cannot make claims regarding minor design or color deviations between the garment and the digital proof.
Determining the Correct Clothing Sizes (Step 2)
4.1. To determine the correct sizes for cycling apparel, the size chart on our website can be used. If measured correctly and the fitting tool is used, a 100% fit guarantee applies. If the clothing does not fit as expected and the customer can prove that correct measurements were taken and the advice matches the delivered product, the customer is entitled to a new product.
Payment (Step 3)
5.1. After finalizing the design, determining the correct sizes, and possibly reviewing the samples, you enter your sizes via our online order portal and pay for the clothing.
5.2. Every customer receives an invoice after payment. You can also request an invoice before making a payment.
5.3. Once payment has been received or proof of payment has been provided, the order is finalized, and production begins.
Clothing Delivery (Step 4)
6.1. The standard delivery time is stated on the website. The delivery time starts once the order payment has been received.
6.2. An express delivery option is available. An additional fee per product is charged to expedite production. If the specified express delivery time is not met, the surcharge can be refunded. However, failure to meet the express delivery timeframe does not entitle the customer to cancel the order entirely or reclaim the full amount.
6.3. The indicated delivery times are estimates, and no rights can be derived from them unless agreed upon in writing. The customer, therefore, has no right to a refund in such cases. During the production process, delays may occur due to production errors, design issues with logos and/or colors, etc. This may result in a longer delivery time than the standard delivery period. If TD fails to meet a super express delivery of 1 to 2 weeks but delivers within 2 to 3 weeks, the customer is entitled to a refund of the difference between the super express and express delivery fees. If delays are caused by demonstrable force majeure (e.g., unforeseen delays, lost packages, or strikes by couriers), there is no entitlement to a refund of express fees.
6.4. A shipping fee of €9.95 excluding VAT is charged for every order.
6.5. If the clothing needs to be shipped to multiple addresses, the total shipping costs for all addresses will be charged.
6.6. The customer receives an email notification with a tracking number once the clothing has been shipped. Typically, the clothing is delivered the next day to the provided delivery address. Different delivery times apply for international orders.
6.7. If the delivery cannot be completed at the customer’s specified address, any additional shipping costs will be borne by the customer.
Payment Terms & Invoicing
7.1. All amounts mentioned in these purchase conditions are excluding VAT.
7.2. TD Sportswear applies a standard payment term of 7 days.
Reorders
8.1. Customers can request a reorder via email at [email protected] or place a reorder via the design module.
8.2. There is no minimum order quantity for reorders.
8.4. The same delivery times and shipping costs apply to reorders.
8.5. Full payment is required in advance for reorders.
Webshops and Gift Cards
9.1. Customers can purchase gift cards that their employees or team members can use in the TD Sportswear webshop.
9.2. Gift cards are valid for two years from the date of purchase and can only be redeemed within the TD Sportswear webshop for the offered products and services.
9.3. The customer is fully responsible for the purchase, distribution, and usage of the gift cards by the intended recipients. TD Sportswear is not liable for any loss, theft, unauthorized use, or non-use of the gift cards by the recipients.
9.4. Gift cards cannot be exchanged for cash, credits, or any other form of financial compensation, regardless of the reason.
9.5. Gift cards that are not redeemed within the two-year validity period automatically and irrevocably expire. No refunds, extensions, or compensation will be provided for unused or partially used gift cards.
9.6. By purchasing gift cards, the customer accepts these terms and waives any right to refunds, compensation, or other financial claims related to the gift cards, regardless of circumstances.
9.7. Any disputes regarding the redemption, validity, or distribution of gift cards are entirely the responsibility of the customer and the recipient of the gift card. TD Sportswear is not a party to such disputes and cannot be held liable.
